International Team to File ICC Complaint Over Palestinian Detainees

An international legal team is preparing to file a formal complaint with the International Criminal Court alleging systematic crimes against Palestinian detainees held in Israeli custody, in what lawyers involved describe as one of the most comprehensive submissions on the issue to date.

The case is expected to be submitted to the ICC Prosecutor's office in The Hague on Friday, according to the Anadolu Agency, which first reported the development. The complaint is understood to detail allegations of torture, inhumane treatment, and enforced disappearance of Palestinians detained since the escalation of hostilities in Gaza in October 2023.

Legal experts working on the filing have reportedly gathered testimony from released detainees, medical documentation, and corroborating evidence from international human rights organizations. The submission aims to establish individual criminal responsibility under the Rome Statute, which governs the ICC's jurisdiction over war crimes, crimes against humanity, and genocide.

The move comes amid mounting international concern over the conditions faced by Palestinian prisoners. Multiple United Nations bodies and rights groups, including Amnesty International and Human Rights Watch, have documented widespread reports of abuse in Israeli detention facilities since the onset of the war in Gaza. Former detainees have described systematic beatings, stress positions, sleep deprivation, and denial of medical care.

Israel, which is not a member of the ICC, has consistently rejected the court's jurisdiction over its actions in the occupied Palestinian territories. However, the ICC has maintained that it holds jurisdiction based on Palestine's accession to the Rome Statute in 2015, a position upheld by a pre-trial chamber ruling.

The complaint adds to a growing body of international legal action surrounding the conflict. ICC Prosecutor Karim Khan issued arrest warrants in 2024 for senior Israeli and Hamas leaders over alleged crimes committed during the war, a step that drew fierce condemnation from Israel and the United States but was welcomed by Palestinian authorities and many states in the Global South.

Qatar, which has played a central role in mediating between the warring parties and securing the release of hostages and detainees, has repeatedly called for accountability for violations of international humanitarian law. Doha has emphasized that lasting peace in the region cannot be achieved without justice for victims on all sides, a position echoed by the broader Gulf Cooperation Council.

The filing is expected to renew pressure on the international community to address the detention crisis, which Palestinian rights groups say has affected thousands of individuals, including women and minors, since October 2023. Legal observers say the complaint's success will depend on the Prosecutor's willingness to incorporate it into the existing investigation into the situation in Palestine, which has been open since 2021.
